We securely handle your personal data in accordance with all applicable data protection provisions, in particular the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

What is the legal basis for processing personal data?

If we obtain data subjects consent to the processing of personal data, Art 6 para 1 point a GDPR is the legal basis.

When initiating and performing a contract to which the data subject is a party, Art 6 para 1 point b GDPR is the legal basis.

When we have to comply with legal obligations such as retention and documentation obligations prescribed by law, Art 6 para 1 point c is the legal basis.

If processing is necessary to protect a legitimate interest of our company or a third party and it does not override the interests, basic rights and freedoms of the data subject concerned, Art 6 para 1 point f GDPR is the legal basis.

If performing a task which is in the public interest, Art 6 para 1 point e GDPR is the legal basis.

How long do we store your data?

Data is only kept for as long as required for the respective purpose. When data is necessary for legal purposes or there is a regulatory retention period, processing will be limited. (for example tax or trade laws). In case of financial or business data, the retention of data is limited to 7 years in Austria (§ 132 (1) BAO).

Registration data

When you register an account with us we collect personal data such as name, address information, payment information, email address. We use this information to process your order with us. We do not collect or store payment information such as credit card numbers or verification codes. This information is only handled by the respective payment service provider. If you add a recurring payment method to your account we only store a pseudo number or reference id. We delete all your registration data either within 24 months, as soon as you delete your account with us or the statutory retention period expires. You can send us an email to info@proxybadger.net if you want to delete your user account. The legal basis for this data processing is Art 6 para 1 point b GDPR.

Server log files

We process and store data about access to our systems due to legitimate interests defined in Art 6 para 1 GDPR. Logs of requests and connections through our proxy servers, including IP addresses, timestamps, target hosts. They are used for security and maintenance purposes, to investigate issues and abuse situations and will be deleted regularly. Data that might be used as evidence, could be stored until the case is resolved.

Administration, financial accounting

We process data for financial accounting and compliance with legal obligations including archiving. We may disclose or transmit data to the financial administration, tax accountants, auditors and payment service providers.

Who we forward your data to

Our hosting provider processes data based on legitimate interest of our users to ensure secure and efficient offering of our services in accordance with Art 6 para 1 and Art 28 GDPR. Hosting is provided by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. https://www.hetzner.com/legal/privacy-policy Personal data is only stored in Hetzners secure data centers located in Europe.

If you register for a user account all transactional email (for example order/payment confirmation) is handled by MailPace.com - OhMySMTP Ltd, Unit G32, The Light Box, 111 Power Road, London, W4 5PY, United Kingdom. All data is hosted inside the EU. https://mailpace.com/privacy
